By booking an appointment, submitting an enquiry, creating an account, providing personal information, purchasing products or services, enrolling in any treatment package or membership, or receiving any consultation or treatment from FORTÉ Clinic, you further agree to be bound by the patient-related provisions of these Terms.

These Terms constitute a legally binding agreement between you and FORTÉ Clinic.

6. ELIGIBILITY

6.1 Patients must be at least eighteen (18) years of age and possess the legal capacity to provide valid informed consent before receiving treatment independently.

6.2 Individuals under the age of eighteen (18) ("Minors") may only receive consultation or treatment where permitted by applicable law and where FORTÉ Clinic is satisfied that appropriate consent has been obtained from a parent or legal guardian.

6.3 FORTÉ Clinic reserves the right to:

  • Require the written consent of a parent or legal guardian before providing consultation or treatment to a Minor;
  • Require a parent or legal guardian to attend consultations, discussions, and treatment appointments involving a Minor;
  • Request proof of age, identity, guardianship, or legal authority before providing any consultation, treatment, product, or service;
  • Refuse or postpone treatment where satisfactory identification or consent cannot be verified; and
  • Decline consultation or treatment for a Minor where, in the professional clinical judgment of the attending medical practitioner, the treatment is medically inappropriate, unnecessary, unsafe, or not in the Minor's best interests.

6.4 FORTÉ Clinic also reserves the right to decline or postpone treatment for any individual who, in the reasonable opinion of the attending medical practitioner, lacks the capacity to provide informed consent or where the Clinic is otherwise unable to obtain valid consent in accordance with applicable law.

6.5 Nothing in this section limits the professional judgment of FORTÉ Clinic's medical practitioners to decline treatment where doing so is clinically appropriate, ethically required, or necessary to comply with applicable laws or professional standards.


7. APPOINTMENTS AND BOOKINGS

7.1 Appointments may be requested through the Website, WhatsApp, telephone, email, social media platforms, third-party booking platforms (where applicable), or in person at FORTÉ Clinic.

7.2 All appointment requests are subject to availability and confirmation by FORTÉ Clinic. An appointment shall not be deemed confirmed until it has been acknowledged and confirmed by an authorised representative of FORTÉ Clinic.

7.3 Patients are responsible for providing accurate and complete booking information, including their name, contact details, and any other information reasonably requested by the Clinic. FORTÉ Clinic shall not be responsible for missed appointments or communication failures resulting from inaccurate or incomplete information provided by the patient.

7.4 Appointment times are estimates only. While FORTÉ Clinic endeavours to provide consultations and treatments at the scheduled time, delays may occur due to medical emergencies, extended consultations, unforeseen clinical circumstances, practitioner availability, or other operational requirements. Patients acknowledge that reasonable waiting times may occasionally be necessary.

7.5 FORTÉ Clinic reserves the right, where reasonably necessary, to:

  • Reschedule, postpone, or cancel appointments;
  • Reassign consultations or treatments to another suitably qualified practitioner;
  • Modify clinic operating hours or appointment availability;
  • Limit or decline appointment bookings;
  • Require a consultation before scheduling certain treatments;
  • Refuse consultation or treatment where it is considered medically inappropriate, contraindicated, unsafe, or otherwise not in the patient's best interests.

7.6 Where FORTÉ Clinic is required to reschedule or cancel an appointment, the Clinic will use reasonable efforts to notify the patient as soon as practicable and, where appropriate, offer an alternative appointment time.

7.7 Patients are expected to arrive on time for their scheduled appointments. Patients who arrive significantly late may have their appointment shortened, rescheduled, or cancelled if the delay would adversely affect subsequent appointments or the safe delivery of treatment. Any applicable cancellation or late-arrival policy shall continue to apply.

7.8 Certain consultations, treatments, packages, or promotional appointments may require a booking deposit or prepayment. Any such requirements will be communicated to the patient before the appointment is confirmed and shall be subject to FORTÉ Clinic's applicable payment, cancellation, and refund policies.

7.9 A confirmed appointment does not guarantee that treatment will be performed. All treatments remain subject to a medical assessment by a qualified practitioner on the day of consultation, who may modify, postpone, or decline treatment where clinically appropriate.

8. DEPOSITS

8.1 FORTÉ Clinic may require a deposit as a condition of booking consultations, medical procedures, treatment sessions, promotional offers, packages, memberships, reserved appointment slots, or other services, as determined by the Clinic from time to time.

8.2 Any deposit requirement, including the amount payable and the deadline for payment, will be communicated to the patient before the appointment or booking is confirmed.

8.3 Unless otherwise stated, a booking requiring a deposit shall not be confirmed until the required deposit has been received by FORTÉ Clinic.

8.4 Subject to applicable law and any specific promotional terms, deposits paid may be applied towards the total fees payable for the relevant consultation, treatment, product, package, or service.

8.5 Deposits are subject to the applicable Refund, Cancellation & Package Policy of FORTÉ Clinic, together with any additional terms communicated at the time of booking, purchase, or promotion.

8.6 Where a patient cancels, reschedules, fails to attend, or is otherwise unable to proceed with an appointment, the treatment of the deposit shall be determined in accordance with FORTÉ Clinic's applicable Refund, Cancellation & Package Policy and any specific booking terms accepted by the patient.

8.7 FORTÉ Clinic reserves the right to require different deposit amounts for different treatments, practitioners, promotional campaigns, packages, or appointment types.

8.8 Nothing in this section limits or excludes any rights or remedies that cannot lawfully be excluded under the applicable laws of Malaysia.


9. TREATMENT SUITABILITY AND PROFESSIONAL DISCRETION

9.1 All consultations, treatments, procedures, prescriptions, and medical recommendations provided by FORTÉ Clinic are subject to a comprehensive medical assessment and the independent professional judgment of the attending qualified medical practitioner.

9.2 FORTÉ Clinic and its medical practitioners reserve the right to refuse, postpone, modify, discontinue, or recommend against any consultation, treatment, procedure, prescription, product, or service where, in the practitioner's professional clinical judgment, it is considered appropriate to do so.

9.3 Without limitation, treatment may be refused, postponed, modified, or discontinued where:

  • The proposed treatment is medically unsuitable;
  • Contraindications, precautions, or significant risks exist;
  • Patient safety may be compromised;
  • Further medical assessment, investigations, laboratory tests, specialist review, or medical clearance is required;
  • The patient has provided incomplete, inaccurate, misleading, or false medical information;
  • The patient has failed to disclose relevant medical history, medications, allergies, previous procedures, or other material information;
  • The patient's expectations are unrealistic or cannot reasonably be achieved;
  • The requested treatment is inconsistent with accepted medical practice, clinical guidelines, or ethical standards;
  • The practitioner reasonably believes that the treatment would not be in the patient's best interests; or
  • Any other circumstance exists that, in the practitioner's professional clinical judgment, makes treatment inappropriate or unsafe.

9.4 Treatment recommendations are based on professional medical judgment following an individual clinical assessment and may differ from a patient's personal preferences, previous treatments received elsewhere, online information, social media content, or marketing materials.

9.5 Patients acknowledge that they are not entitled to insist upon, demand, or receive any specific treatment, procedure, medication, product, technology, or technique where the attending practitioner determines that such treatment is unsuitable, contraindicated, medically unnecessary, or unsafe.

9.6 Where clinically appropriate, FORTÉ Clinic may recommend alternative treatments, staged treatment plans, referral to another healthcare provider, further investigations, or no treatment at all. Such recommendations are made in the interests of patient safety and appropriate clinical care and do not constitute a breach of any booking, consultation, promotional offer, or treatment request.

9.7 Nothing in this section limits or excludes any rights or remedies that cannot lawfully be excluded under the applicable laws of Malaysia.


10. PATIENT RESPONSIBILITIES

10.1 Patients are responsible for actively participating in their own healthcare and agree to:

  • Provide complete, accurate, current, and truthful personal, medical, and contact information;
  • Disclose all relevant medical conditions, illnesses, allergies, medications, supplements, previous surgeries, cosmetic procedures, aesthetic treatments, implants, pregnancy, breastfeeding status, and any other information that may affect treatment safety or outcomes;
  • Inform FORTÉ Clinic of any changes to their medical condition, medications, allergies, pregnancy status, or other relevant circumstances before receiving any consultation or treatment;
  • Answer all medical questionnaires honestly and to the best of their knowledge;
  • Follow all pre-treatment instructions, post-treatment care instructions, medication directions, and aftercare recommendations provided by FORTÉ Clinic;
  • Attend recommended follow-up appointments, reviews, and emergency assessments where advised by the treating practitioner;
  • Contact FORTÉ Clinic promptly if they experience unexpected symptoms, adverse reactions, complications, or concerns following treatment;
  • Use prescribed or recommended medications and skincare products only in accordance with the instructions provided; and
  • Comply with any other reasonable clinical or administrative requirements communicated by FORTÉ Clinic.

10.2 Patients acknowledge that the safety, suitability, and effectiveness of treatment depend, in part, upon the accuracy and completeness of the information they provide and their compliance with medical advice and aftercare instructions.

10.3 To the extent permitted by applicable law, FORTÉ Clinic shall not be responsible for adverse outcomes, complications, delays in recovery, reduced treatment effectiveness, or other consequences arising wholly or partly from:

  • Inaccurate, incomplete, misleading, or false information provided by the patient;
  • Failure to disclose relevant medical history or other material information;
  • Failure to follow pre-treatment or post-treatment instructions;
  • Failure to attend recommended follow-up appointments or seek timely medical review;
  • Failure to use prescribed medications or recommended products as directed; or
  • Any act or omission of the patient that materially contributes to the outcome.

10.4 Nothing in this section excludes or limits any liability of FORTÉ Clinic that cannot lawfully be excluded or limited under the applicable laws of Malaysia.


11. PATIENT CONDUCT

11.1 FORTÉ Clinic is committed to providing a safe, respectful, professional, and welcoming environment for all patients, visitors, practitioners, and staff.

11.2 Patients, accompanying persons, and visitors are expected to behave respectfully and comply with all reasonable directions, safety requirements, and clinic policies while on the Clinic's premises or when communicating with FORTÉ Clinic through any channel.

11.3 FORTÉ Clinic reserves the right to refuse service, terminate consultations, postpone or cancel appointments, require a patient or visitor to leave the premises, or discontinue the professional relationship where, in the reasonable opinion of the Clinic, a person:

  • Behaves in an abusive, aggressive, violent, intimidating, threatening, or harassing manner;
  • Uses offensive, discriminatory, defamatory, or inappropriate language or conduct;
  • Engages in sexual harassment or any form of inappropriate behaviour towards staff, practitioners, patients, or visitors;
  • Is intoxicated or appears to be under the influence of alcohol or non-prescribed drugs to an extent that may compromise safety, communication, or informed consent;
  • Provides false, misleading, fraudulent, or forged information or documentation;
  • Repeatedly breaches these Terms, clinic policies, appointment requirements, or reasonable instructions issued by FORTÉ Clinic;
  • Secretly records, photographs, or films staff, practitioners, other patients, or restricted areas of the Clinic without prior consent, except where permitted by law;
  • Wilfully damages or attempts to damage Clinic property or equipment;
  • Endangers, or is reasonably considered likely to endanger, the safety, wellbeing, privacy, or security of staff, practitioners, patients, visitors, or Clinic property; or
  • Otherwise engages in conduct that materially disrupts the safe and effective operation of the Clinic.

11.4 Where clinically appropriate and reasonably practicable, FORTÉ Clinic may arrange for the continuation of necessary medical care through an alternative appointment, practitioner, or referral. However, the Clinic reserves the right to immediately discontinue services where this is necessary to protect the safety or wellbeing of patients, staff, practitioners, or visitors.

11.5 Any refusal of service or termination of the professional relationship under this section shall not affect any outstanding fees or other obligations already incurred by the patient.

11.6 Nothing in this section limits or excludes any rights or remedies that cannot lawfully be excluded under the applicable laws of Malaysia.


12. TREATMENT PACKAGES, MEMBERSHIPS AND PROMOTIONS

12.1 Treatment packages, memberships, prepaid treatments, vouchers, gift cards, promotional offers, loyalty programmes, referral programmes, and other special offers provided by FORTÉ Clinic may be subject to separate terms and conditions, including FORTÉ Clinic's Refund, Cancellation & Package Policy and any promotion-specific terms communicated at the time of purchase.

12.2 Patients are responsible for reviewing and understanding all applicable terms, conditions, eligibility requirements, expiry dates, usage restrictions, and exclusions before purchasing or redeeming any package, membership, voucher, promotional offer, or prepaid service.

12.3 Unless expressly stated otherwise in the applicable terms, promotional offers, discounts, vouchers, referral rewards, memberships, and package benefits:

  • Cannot be exchanged for cash;
  • Are non-transferable;
  • Cannot be combined with other promotions or discounts unless expressly permitted by FORTÉ Clinic; and
  • Must be used in accordance with the applicable promotional terms and any expiry dates.

12.4 FORTÉ Clinic reserves the right to introduce, amend, suspend, withdraw, or discontinue any promotion, campaign, membership programme, loyalty programme, referral programme, voucher, or special offer where reasonably necessary, provided that such changes shall not adversely affect contractual rights that have already accrued to patients under applicable law or the specific terms accepted at the time of purchase.

12.5 Where a package, membership, or promotional offer has already been purchased, its use shall be governed by the terms and conditions in effect at the time of purchase, unless a variation is required by law, is agreed to by the patient, or is otherwise permitted under the applicable terms.

12.6 Nothing in this section limits or excludes any rights or remedies that cannot lawfully be excluded under the applicable laws of Malaysia.


13. PRODUCTS AND RETAIL ITEMS

13.1 FORTÉ Clinic may offer skincare products, haircare products, medical-grade skincare, supplements, medical devices, wellness products, prescription items (where legally permitted), and other retail products for purchase, subject to availability and applicable laws.

13.2 Product availability may vary due to supplier availability, stock levels, manufacturer changes, regulatory requirements, or other operational circumstances. FORTÉ Clinic does not guarantee the continued availability of any particular product or brand.

13.3 Product recommendations are provided based on the information available at the time of consultation and the patient's individual circumstances. Patients acknowledge that individual responses to skincare, supplements, and other products may vary and that no specific outcome or result is guaranteed.

13.4 Patients are responsible for:

  • Following all product instructions, warnings, and directions for use;
  • Using products only for their intended purpose;
  • Informing FORTÉ Clinic of any allergies, sensitivities, adverse reactions, or relevant medical conditions before purchasing or using a product; and
  • Discontinuing use and seeking appropriate medical advice if an unexpected or adverse reaction occurs.

13.5 Certain products may be subject to manufacturer warranties, supplier policies, regulatory requirements, usage restrictions, or prescription requirements. Where applicable, such terms shall apply in addition to these Terms.

13.6 Product purchases may also be subject to FORTÉ Clinic's Refund, Cancellation & Package Policy and any additional terms communicated at the time of purchase.

13.7 Except where required by applicable law, FORTÉ Clinic does not warrant that any product will achieve a particular medical, therapeutic, cosmetic, or aesthetic result.

13.8 Nothing in this section excludes, restricts, or limits any statutory guarantees, consumer rights, or remedies that cannot lawfully be excluded under the applicable laws of Malaysia.


14. CLINICAL PHOTOGRAPHY AND MEDICAL RECORDS

14.1 FORTÉ Clinic may, where clinically appropriate, take photographs, videos, three-dimensional images, skin analysis images, scans, or other visual records before, during, and after consultation or treatment for purposes including:

  • Medical documentation;
  • Clinical assessment and diagnosis;
  • Treatment planning;
  • Progress monitoring;
